Jurisdiction or competent courts
The parties, expressly waiving any jurisdiction that may correspond to them, for issues that may arise or actions to be exercised on the interpretation of compliance or non-compliance with what is agreed herein, expressly submit to the Judges and Courts of the city of Valencia.
Billing
The customer agrees to receive the invoices and credits for their returns in electronic format.
Shipping
All the shipping times shown are estimates, and they start counting from the moment the order has left our warehouses.
Shipments are made worldwide.

The availability of the products will be clearly indicated on the web and the closing of the purchase will not be possible with a product that is not in stock at that time if the opposite is not indicated on the product.
The customer will have 48 hours from delivery to check the integrity of the order and all the components it includes. After these 48 hours, the shipment will be considered accepted and claims for damages caused in transport will not be accepted.
An order will be considered delivered when the delivery receipt is signed by the customer.
In case of receiving a product damaged by transport, contact within the first 48 hours via email info@luxotica.es indicating the order number and the problem. In the same way, it is convenient to contact the transport company to record the incident (UPS ESPAÑA TEL: +34 91 745 64 00).
Returns
Carmen Chirivella Navarro S.L offers the possibility of returning products within the first 30 calendar days, for whatever reason, from the date of receipt of the merchandise by the customer, and provided that the conditions set out on this page are met.
Returns of the following products will not be accepted, as established by LAW 47/2002, of December 19, amending Law 7/1996, of January 15, on Retail Trade, for transposition into the legal system Spanish of Directive 97/7 / CE, regarding distance contracts, and for the adaptation of the Law to various Community Directives.
Products subject to fluctuations in financial market coefficients that the seller cannot control.
Products made according to customer specifications, custom orders or clearly personalized, specifically assembled according to a personalized configuration. Products that by their nature cannot be returned or may deteriorate or expire quickly.
Article 45. Exceptions to the right of withdrawal. Unless otherwise agreed, the provisions of the previous article will not be applicable to the following contracts:
- Contracts for the supply of goods whose price is subject to fluctuations in financial market coefficients that the seller cannot control.
- Contracts for the supply of goods made according to the consumer’s specifications or clearly personalized, or which, due to their nature, cannot be returned or may deteriorate or expire quickly.
- Contracts for the supply of sound or video recordings, discs and computer programs that have been unsealed by the consumer, as well as computer files, supplied electronically, capable of being downloaded or reproduced immediately for permanent use.
- Contracts for the supply of daily newspapers, periodicals and magazines.
To make a return you must contact us at info@luxotica.es and we will provide you with a return form. Once this request has been filled out, a return number will be assigned and the data for the shipment will be indicated.
All merchandise must be returned in its entirety, in its original packaging, in perfect condition and protected so that it is not received with seals or adhesive transport tapes. Otherwise, Carmen Chirivella Navarro S.L reserves the right to reject the return.
Returns must be delivered at destination within 7 days after the date of acceptance of the return. Otherwise it will be rejected and returned.
Once the merchandise has been received and verified that it is in perfect condition, the return of the merchandise amount will be processed less the shipping cost within a maximum period of 15 days.
IMPORTANT: If a product has manifest defects or is in poor condition due to transport (blows, water, etc.), CARMEN CHIRIVELLA NAVARRO S.L must be notified within 48 hours AFTER ACCEPTING THE ORDER. So we can claim it and proceed to replace it with another unit in perfect condition. Otherwise, CARMEN CHIRIVELLA NAVARRO S.L reserves the right to accept the return.
Refunds for returns will have a maximum period of 15 calendar days for administrative procedures, although we usually do them in no more than 7 days.
Cases in which we cannot accept orders
CARMEN CHIRIVELLA NAVARRO S.L reserves the right to cancel any purchase (of an order previously accepted by us), without being responsible for any damage or expense, among others, in the following situations:
- The product is not in stock / the product is out of stock (in which case you have the option of a refund of the purchase amount made or you can wait until we are back in stock).
- Your billing information is not correct or cannot be verified.
- Your order is signaled by our security systems as an abnormal order or one that may be fraudulent.
- We have reason to believe that you are under the age of 14.
- We have reason to believe that it was done maliciously.
- The order is the result of an error in the store’s system (misapplied discounts, unaccounted shipping costs, etc.).
- We were unable to deliver to the address you provided.
We will not be liable to you or to any third party for removing any product from this website, regardless of whether said product has been sold or not, removing or modifying any material or content on the website, or for denying us to process an order once we have sent you the Order Confirmation.
In the event that any additional information or confirmation is required to serve an order and once requested there is no response within 7 calendar days, we will proceed to cancel the order and, if applicable, return the amount.
If the order is at its destination and after 7 calendar days it is impossible for us to make the delivery (the customer is not at home, does not respond to our communications, etc.) we will proceed to collect it and refund the amount, except for expenses generated.
Return conditions for distributors
Returns of material will only be accepted without unsealing and in perfect condition, during the 7 days after receipt.
Such returns will be processed as commercial returns, since there is no law that regulates the rights of return between companies and such procedures are regulated according to the conditions of CARMEN CHIRIVELLA NAVARRO S.L.
It will not be possible to return blister or heat-sealed products, and other products that have a broken factory security seal.
Said conditions do not void the right to guarantee or exchange defective products as stipulated in the manufacturer’s warranty. CARMEN CHIRIVELLA NAVARRO S.L reserves the right to deny the return in case of detecting any anomaly in the returned product.
Cancellation of orders
Those order cancellations that involve a return to the customer will have a maximum period of 14 days for administrative procedures, although we try to ensure that the period does not exceed 7 days.
Order cancellations will not be allowed after 1h. of the closing of the purchase since it will be assumed that the order has already been processed by the warehouse. For any questions, send an email indicating the order number to info@luxotica.es
Withdrawal
If the order you have placed does not correspond to your expectations, you have the possibility to exercise the right of withdrawal within 14 days in accordance with article 71 Royal Legislative Decree 1/2007, of November 16, by which approves the revised text of the General Law for the Defense of Consumers and Users and other complementary laws from the moment you or someone authorized by you receives the package.
To exercise your right of withdrawal, you must notify us in writing of your decision to our email: info@luxotica.es
To make it easier for you, from CARMEN CHIRIVELLA NAVARRO S.L we will provide you with the form that you must send us. Once the receipt of your request has been confirmed, we will proceed to pay you the amount paid by paypal, check or bank transfer within a period of 10 calendar days from the receipt of your withdrawal request, as long as the return of the product has been completed.
The exercise of the right of withdrawal will imply the refund of the price of the returned product.
